The petition to revive the above identified trademark application submitted on November 2, 2009 is denied pursuant to Trademark Rule 2.66. The application remains abandoned.
The petition is denied for the following reason.
The petition is untimely. A petition to revive must be filed within two months of the mailing date of the notice of abandonment. Trademark Rule 2.66. In this case, the mailing date of the notice of abandonment is August 17, 2009, but the petition was not filed until November 2, 2009.
The Office issued a suspension inquiry by e-mail on January 16, 2009 which required action on your part. An applicant who authorizes the United States Patent and Trademark Office (USPTO) to send correspondence by e-mail is solely responsible for receipt of documents sent via e-mail. There is a clear warning about this on the application form when the box is checked authorizing e-mail.
Applicant may file a new application. The United States Patent and Trademark Office recommends that new applications be filed using the Trademark Electronic Application System (TEAS), available over the Internet at http://www.uspto.gov.
