This is responsive to the communication received September 10, 2008.
SECTION 2(d) REFUSAL MADE FINAL – LIKELIHOOD OF CONFUSION
Registration of the applied-for mark was refused because of a likelihood of confusion with the mark in U.S. Registration No. 2554447. Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP §§1207.01 et seq. This refusal is continued and made Final.
In this case, the following factors are the most relevant: similarity of the marks, similarity of the goods and/or services, and similarity of trade channels of the goods and/or services. See In re Opus One, Inc., 60 USPQ2d 1812 (TTAB 2001); In re Dakin’s Miniatures Inc., 59 USPQ2d 1593 (TTAB 1999); In re Azteca Rest. Enters., Inc., 50 USPQ2d 1209 (TTAB 1999); TMEP §§1207.01 et seq.
Applicant’s mark, MST, is confusingly similar to registrant’s mark, MST 9000 WORKS WONDERS IN PRODUCT DATA MANAGEMENT. MST is the salient feature of each mark. MST is the only literal portion of applicant’s mark and it comprises the largest letters in registrant’s mark. WORKS WONDERS IN PRODUCT DATA MANAGEMENT is laudatory. MST is strong as applied to the services since it is arbitrary.
Applicant’s services, Computer software development are closely related to registrant’s services, Computer programming for others; computer software design and consultation in the field of automatic data processing; data processing services.
Attached is an advertisement of Minneapolis Consulting Group downloaded from GOOGLE on October 2, 2008 for the services of computer software development and computer programming.
