The assigned examining attorney has reviewed the referenced application and determined the following.  The amendment with the signature has been received and entered.

 

Section 2(d) - Likelihood of Confusion Refusal

 

Registration of the proposed mark is refused because of a likelihood of confusion with the marks in U.S. Registration Nos. 3217996 and 2264110.  Trademark Act Section 2(d), 15 U.S.C. §1052(d); TMEP §§1207.01 et seq.  See the enclosed registrations.

 

Both registrations are for the same mark and are owned by the same registrant and are for CREST for use on articles of clothing for the health care industry, namely, pants, pantsuits, jumpsuits, skirt, blouses, dresses and culottes.  Applicant’s proposed mark is also CREST and is also for use on clothing items.   Consumers may be confused as to the source of the goods.

 

Neither the application nor the registration(s) contain any limitations regarding trade channels for the goods and therefore it is assumed that registrant’s and applicant’s goods are sold everywhere that is normal for such items, i.e., clothing and department stores.  Thus, it can also be assumed that the same classes of purchasers shop for these items and that consumers are accustomed to seeing them sold under the same or similar marks.  See Kangol Ltd. V. KangaROOS U.S.A. Inc., 974 F.2d 161, 23 USPQ2d 1945 (Fed. Cir. 1992); In re Smith and Mehaffey, 31 USPQ2d 1531 (TTAB 1994).

 

The decisions in the clothing field have held many different types of apparel to be related under Section 2(d).  Cambridge Rubber Co. v. Cluett, Peabody & Co., Inc., 286 F.2d 623, 128 USPQ 549 (C.C.P.A. 1961) (“WINTER CARNIVAL” for women’s boots v. men’s and boys’ underwear); Jockey Int’l, Inc. v. Mallory & Church Corp., 25 USPQ2d 1233 (TTAB 1992) (“ELANCE” for underwear v. “ELAAN” for neckties); In re Melville Corp. 18 USPQ2d 1386 (TTAB 1991) (“ESSENTIALS” for women’s pants, blouses, shorts and jackets v. women’s shoes); In re Pix of America, Inc., 225 USPQ 691 (TTAB 1985) (“NEWPORTS” for women’s shoes v. “NEWPORT” for outer shirts); In re Mercedes Slacks, Ltd., 213 USPQ 397 (TTAB 1982) (“OMEGA” for hosiery v. trousers); In re Cook United, Inc., 185 USPQ 444 (TTAB 1975) (“GRANADA” for men’s suits, coats, and trousers v. ladies’ pantyhose and hosiery); Esquire Sportswear Mfg. Co. v. Genesco Inc., 141 USPQ 400 (TTAB 1964) (“SLEEX” for brassieres and girdles v. slacks for men and young men).

 

Identification of goods

 

The identification of goods is unacceptable as indefinite because it could include goods in other classes.  The applicant may adopt the following identification, if accurate:    TMEP §1402.01.

 

Class 18:  Sport bags; overnight bags; book bags; backpacks; handbags; wallets; tri-fold bill folds; hip-fold bill folds; credit card cases; credit card money folds; travel kit bags sold empty; luggage; purses; coin purses; cosmetic cases; tote bags; carry-on tote bags; briefcases; travel bags; duffel bags and cloth shopping bags.  Multi purpose Cloth bags are in Class 22.

 

Class 22: Multi purpose cloth bags.

 

Class 25:  Men's sportswear, women's sportswear, tailored clothing, neckwear, namely, ties and scarves, dress shirts, underwear, children's clothing and shoes.  Clothing alone is indefinite and unclear, applicant must specify what the sportswear and clothing are by common commercial name.

 

Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.

 

Combined Applications

 

If applicant prosecutes this application as a combined, or multiple-class application, applicant must comply with each of the following for those goods and/or services based on an intent to use the mark in commerce under Trademark Act Section 1(b):

 

(1)   Applicant must list the goods and/or services by international class with the classes listed in ascending numerical order; and

 

(2)   Applicant must submit a filing fee for each international class of goods and/or services not covered by the fee already paid (current fee information should be confirmed at http://www.uspto.gov).
