The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

Identification of Goods

 

The identification of goods is unacceptable as indefinite.  Applicant must clarify the identification of goods by specifying types of hand tools.  TMEP §1402.01.

 

Furthermore, examining attorney proposes a number of minor changes to applicant’s language for uniformity purposes and in order to improve the clarity of the identification of goods.  Please see identification suggestions below.   

 

Applicant may adopt the following identification of goods, if accurate: 

 

Class 8:  “Files; Nail drawers, namely, carpenters’ pincers; Saws; Wrenches; Hand tools, namely, {specify item e.g., planers, drills, shovels}; Hand tools, namely, gouges; Screwdrivers; Bits for hand drills; Nippers; Hand tools, namely, rams.”
