The above-identified APPLICATION IS ABANDONED because the request for extension of time to file a statement of use (extension request) was filed after the six-month period following issuance of the notice of allowance. The extension request is untimely and will not be reviewed.
A statement of use or extension request is required to be filed within six months following the issuance of a notice of allowance or during an existing extension period. 15 U.S.C. §1051(d); 37 C.F.R. §§2.88 and 2.89; TMEP §§1108.01 and 1109.04. In this case, the extension request was due on or before May 11, 2009, but the extension request was not filed until May 13, 2009.
