The assigned trademark examining attorney has reviewed the referenced application and has determined the following:

 

SEARCH RESULTS

 

The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

However, applicant must address the following issues:

 

SURNAME REFUSAL

 

Registration is refused because the proposed mark is primarily merely a surname.  Trademark Act Section 2(e)(4), 15 U.S.C. §1052(e)(4); TMEP §§1211 et seq.  The primary significance of the mark to the purchasing public determines whether a term is primarily merely a surname.  In re Etablissements Darty et Fils, 759 F.2d 15, 225 USPQ 652, 653 (Fed. Cir. 1985); In re Kahan & Weisz Jewelry Mfg. Corp., 508 F.2d 831, 184 USPQ 421 (C.C.P.A. 1975).

 

Please see the attached evidence from Lexis/Nexus, establishing the surname significance of the surname “AMES”.  This evidence shows the proposed mark appearing 10,711 times as a surname in a nationwide telephone directory of names. The first 100 results appear at the end of this Office Action.

 

The fact that a term looks and sounds like a surname may also contribute to a finding that the primary significance of the term is that of a surname.  In re Giger, 78 USPQ2d 1405, 1409 (TTAB 2006); In re Gregory, 70 USPQ2d 1792, 1796 (TTAB 2004); In re Industrie Pirelli Societa per Azioni, 9 USPQ2d 1564, 1566 (TTAB 1988); In re Petrin Corp., 231 USPQ 902, 904 (TTAB 1986); TMEP §1211.01(a)(vi). In this case, applicant’s mark has the look and feel of a surname. Please see the attached printouts from an online search index showing surnames with similar spellings to applicant’s mark.

 

Accordingly, in light of the evidence of record, applicant’s mark is refused registration under Section 2(e)(4) of the Trademark Act as primarily merely a surname.

 

RESPONSE

 

Although the trademark examining attorney has refused registration, applicant may respond to the refusal to register by submitting evidence and arguments in support of registration.

 

SECTION 2(F) CLAIM OF ACQUIRED DISTINCTIVENESS MAY BE APPROPRIATE

 

A mark deemed primarily merely a surname may be registered on the Principal Register under Section 2(f) (“acquired distinctiveness) in appropriate cases.  An intent-to-use applicant who has used the mark on related goods and/or services may file a claim of acquired distinctiveness under Trademark Act Section 2(f) before filing an allegation of use if applicant can establish that, as a result of applicant’s use of the mark on other goods and/or services, the mark has become distinctive of the goods and/or services in the intent-to-use application, and that this previously created distinctiveness will transfer to the goods and/or services in the intent-to-use application when use in commerce begins.  In re Dial-A-Mattress Operating Corp., 240 F.3d 1341, 1347, 57 USPQ2d 1807, 1812 (Fed. Cir. 2001); TMEP §1212.09(a). 

 

The Trademark Trial and Appeal Board has set forth the requirements for showing that a mark in an intent-to-use application has acquired distinctiveness:

 

(1)    Applicant must establish that the same mark has acquired distinctiveness as to the other goods and/or services, by submitting evidence such as ownership of a prior registration for the same mark for related goods and/or services, a prima facie showing of acquired distinctiveness based on five years’ use of the same mark with related goods and/or services, or actual evidence of acquired distinctiveness for the same mark with respect to the other goods and/or services; and

 

(2)    Applicant must show the extent to which the goods and/or services recited in the intent-to-use application are related to the goods and/or services in connection with which the mark has acquired distinctiveness to warrant the conclusion that the previously created distinctiveness will transfer to the goods and/or services in the application upon use.  The showing necessary to establish relatedness will be decided on a case by case basis and will depend upon the nature of the goods and/or services involved and the language used to identify them in the application.

If applicant chooses to respond to the refusal to register, then applicant must also respond to the following requirements.

 

CLAIM OWNERSHIP OF PRIOR REGISTRATIONS

 

If applicant is the owner of U.S. Registration Nos. 0262338, 2927060 and 3101032, then applicant must submit a claim of ownership.  37 C.F.R. §2.36; TMEP §812.  See attached registrations. The following standard format is suggested:

IDENTIFICATION OF GOODS IS INDEFINITE

 

The following item in the identification of goods is indefinite and must be clarified: “replacement blades”.  Applicant must specify what the blades are for, i.e., “replacement blades for saws”.  Applicant may adopt the following identification, if accurate:   TMEP §1402.01.

 

International Class 008: “Manually operated hand tools, namely, pruners, grass shears, hedge shears, loppers, saws, pole tree trimmers, garden scissors, floral shears, bush hooks, bank blades, weed cutters, grass whips, grass hooks, floral snips, bow saws, folding saws, double-edge saws, replacement blades for {specify, i.e., saws}, machete corn knives and weed hooks”
