This letter responds to the applicant’s Response to Office Action, received March 11, 2008.
The examining attorney has reviewed the applicant’s Response to Office Action, and has determined the following:
The following requirement has been satisfied and is now withdrawn:
(1) Requirement that the applicant amend the identification of services so as to comply with the requirements of the Trademark Act.
TMEP §714.04.
However, at this time, the applicant must respond to the following newly issued refusal to registration:
Registration Refused – Applicant is Not the Owner of the Mark
Registration is refused because, as set out in the June 15, 2007 Preliminary Amendment, the applicant is not the owner of the mark. Trademark Act Section 1, 15 U.S.C. §1051. Only the owner of a mark may apply to register the mark. See TMEP §1201.02(b).
The examining attorney apologizes for the timing of this newly issued refusal.
Although the trademark examining attorney has refused registration, the applicant may respond to the refusal to register by submitting evidence and arguments in support of registration.
