The assigned trademark examining attorney has reviewed the referenced application and has determined the following:

 

Section 2(d) - Likelihood of Confusion Refusal

 

Registration of the proposed mark is refused because of a likelihood of confusion with the marks in U.S. Registration Nos. 3119269 and 2613732.  Trademark Act Section 2(d), 15 U.S.C. §1052(d); TMEP §§1207.01 et seq.  See the enclosed registrations.

 

Taking into account the relevant Du Pont factors, a likelihood of confusion determination in this case involves a two-part analysis.  First, the marks are compared for similarities in appearance, sound, connotation and commercial impression.  In re E .I. du Pont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973).  Second, the goods or services are compared to determine whether they are similar or related or whether the activities surrounding their marketing are such that confusion as to origin is likely.  In re National Novice Hockey League, Inc., 222 USPQ 638 (TTAB 1984); In re August Storck KG, 218 USPQ 823 (TTAB 1983); In re Int’l Tel. and Tel. Corp., 197 USPQ 910 (TTAB 1978); Guardian Prods. Co., v. Scott Paper Co., 200 USPQ 738 (TTAB 1978); TMEP §§1207.01 et seq.

 

First, the marks are compared for similarities in sound, appearance, meaning or connotation.  In re E .I. du Pont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973).  Similarity in any one of these elements may be sufficient to find a likelihood of confusion.  In re White Swan Ltd., 8 USPQ2d 1534, 1536 (TTAB 1988); In re Lamson Oil Co., 6 USPQ2d 1041, 1043 (TTAB 1987); In re Mack, 197 USPQ 755 (TTAB 1977); TMEP §1207.01(b).  Marks may be confusingly similar in appearance where there are similar terms or phrases or similar parts of terms or phrases appearing in both applicant’s and registrant’s mark.  See e.g., Crocker Nat’l Bank v. Canadian Imperial Bank of Commerce, 228 USPQ 689 (TTAB 1986), aff’d 1 USPQ2d 1813 (Fed. Applicant’s mark ACTIVA is similar in sound appearance, and overall commercial impression to the registered ACTIVIA marks.  The marks are nearly identical in appearance, the only difference is applicant’s deletion of the letter I.  As a general rule, consumers are more inclined to focus on the first word, prefix or syllable in any trademark or service mark.  See Palm Bay Imps., Inc. v. Veuve Clicquot Ponsardin Maison Fondee En 1772, 396 F. 3d 1369, 1372, 73 USPQ2d 1689, 1692 (Fed. Cir. 2005); see also Presto Prods., Inc. v. Nice-Pak Prods., Inc., 9 USPQ2d 1895, 1897 (TTAB 1988) (“it is often the first part of a mark which is most likely to be impressed upon the mind of a purchaser and remembered” when making purchasing decisions).  Here, the first two syllables of the marks are identical ACTIV.  Further, these syllables will be pronounced like the word “active” and that is the meaning that consumers will likely attribute to the mark.  The overall commercial impression of the marks is the same.

 

The registered marks do contain a design component.  However, when a mark consists of a word portion and a design portion, the word portion is more likely to be impressed upon a purchaser’s memory and to be used in calling for the goods or services.  Therefore, the word portion is normally accorded greater weight in determining likelihood of confusion.  In re Dakin’s Miniatures Inc., 59 USPQ2d 1593, 1596 (TTAB 1999); In re Appetito Provisions Co., 3 USPQ2d 1553 (TTAB 1987); Amoco Oil Co. v. Amerco, Inc., 192 USPQ 729 (TTAB 1976); TMEP §1207.01(c)(ii).

 

Second, the goods and/or services of the parties need not be identical or directly competitive to find a likelihood of confusion.  Instead, they need only be related in some manner, or the conditions surrounding their marketing are such that they would be encountered by the same purchasers under circumstances that would give rise to the mistaken belief that the goods and/or services come from a common source.  On-line Careline Inc. v. America Online Inc., 229 F.3d 1080, 56 USPQ2d 1471 (Fed. Cir. 2000); In re Martin’s Famous Pastry Shoppe, Inc., 748 F.2d 1565, 223 USPQ 1289 (Fed. Cir. 1984); In re Melville Corp., 18 USPQ2d 1386, 1388 (TTAB 1991); In re Corning Glass Works, 229 USPQ 65 (TTAB 1985); In re Rexel Inc., 223 USPQ 830 (TTAB 1984); Guardian Prods. Co., Inc. v. Scott Paper Co., 200 USPQ 738 (TTAB 1978); In re Int’l Tel. & Tel. Corp., 197 USPQ 910 (TTAB 1978); TMEP §1207.01(a)(i).

 

Applicant’s goods are “Yogurt, cream, cheese, cream cheese and other dairy products.”

 

Registrant’s goods include:

 

milk, powdered milk gelled, flavored milk, beaten milk; dairy products, namely, milky desserts namely, crème brulee, caramel cream, whipped cream, cream mould, yogurts, yogurt based beverages, creams, dessert creams, fresh cream, butter, cheese spreads, cheeses, matured cheeses, matured cheeses with mould, fresh mild cheeses, cheeses in brine, white cheese, strained cheeses, fresh cheeses sold in paste or liquid form, plain or flavored; beverages consisting mostly of milk or of dairy products, namely, yogurt based beverages, beverages consisting mostly of milk starter cultures, namely, plain or aromatized whipped cream, plain or aromatized fermented milk, plain or aromatized sour milk, plain or aromatized lactobacillus beverages, plain or aromatized kefir, plain or aromatized koumiss, plain or aromatized yogurt, plain or aromatized acidophilus milk, plain or aromatized concentrated fermented milk, flavored fermented milk, milky beverages with fruits; edible oils, olive oils, edible fats.

 

Coffee, tea, cocoa, chocolate, sugar, rice, puffed rice, tapioca; flours, sweet or salted tarts and pies, pizzas; plain or flavored stuffed noodles, dishes made from cereals, breakfast cereals; prepared foods consisting entirely or partially of noodles; prepared foods consisting entirely or partially of tart pastry; bread, toasted breads, sweet or savory cookies, wafers, waffles, cakes, pastries, all these products being plain, coated, filled, flavored; frozen yogurt, ice cream, ice water sorbets, frozen flavored water ice creams, honey, salt, mustard, vinegar, condiment sauces, namely, sweet sauces, pasta sauces, spices; milk based mousses desserts, milk based chocolate mousses.

 

Applicant is providing goods that are identical to those of the registrant.  If the goods or services of the respective parties are closely related, the degree of similarity between marks required to support a finding of likelihood of confusion is not as great as would apply with diverse goods or services.  Century 21 Real Estate Corp. v. Century Life of America, 970 F.2d 874, 877, 23 USPQ2d 1698, 1701 (Fed. Cir. 1992), cert. denied 506 U.S. 1034 (1992); In re J.M. Originals Inc., 6 USPQ2d 1393 (TTAB 1987); ECI Division of E-Systems, Inc. v. Environmental Communications Inc., 207 USPQ 443 (TTAB 1980); TMEP §1207.01(b).

 

Applicant’s use of a mark with the same overall commercial impression as the registered mark on closely related to identical goods is likely to cause confusion as to the source of the goods.  Any doubt regarding a likelihood of confusion is resolved in favor of the prior registrant.  Hewlett-Packard Co. v. Packard Press Inc., 281 F.3d 1261, 62 USPQ2d 1001, 1004 (Fed. Cir. 2002); In re Hyper Shoppes (Ohio), Inc., 837 F.2d 463, 6 USPQ2d 1025 (Fed. Cir. 1988); TMEP §§1207.01(d)(i).

 

Accordingly, registration of the proposed mark is refused due to a likelihood of confusion with the registered marks cited above.

 

Although the trademark examining attorney has refused registration, applicant may respond to the refusal to register by submitting evidence and arguments in support of registration.

 

If applicant chooses to respond to the refusal(s) to register, then applicant must also respond to the following requirement(s).

 

Prior Pending Applications May Also Pose a Bar to Registration

 

Information regarding pending Application Serial Nos. 78907913 and 78887053 is enclosed.  The filing dates of the referenced applications precede applicant’s filing date.  There may be a likelihood of confusion under Trademark Act Section 2(d) between applicant’s mark and the referenced marks.  If one or more of the referenced applications registers, registration may be refused in this case under Section 2(d).  37 C.F.R. §2.83; TMEP §§1208 et seq.  Therefore, upon entry of a response to this Office action, action on this case may be suspended pending final disposition of the earlier-filed applications.

 

If applicant believes that there is no potential conflict between this application and the earlier-filed applications, then applicant may present arguments relevant to the issue in a response to this Office action.  The election not to submit arguments at this time in no way limits applicant’s right to address this issue at a later point.

 

Identification of Goods

 

The wording “other dairy products” in the identification of goods is indefinite and must be clarified because it is overly broad and refers to goods in other International Classes.  TMEP §1402.01.  Applicant must indicate the common commercial name of all dairy products.

 

Applicant may adopt the following identification of goods, if accurate: 

 

International Class 29

 

Yogurt, cheese, cream, cream cheese, and other dairy products, namely, [indicate common commercial name of dairy products, e.g., butter, milk, dairy products excluding ice cream, ice milk and frozen yogurt, etc]

 

International Class 30

 

Dairy products, namely ice cream

If applicant prosecutes this application as a combined, or multiple-class application, applicant must comply with each of the following for those goods and/or services based on an intent to use the mark in commerce under Trademark Act Section 1(b):
