THIS IS A FINAL ACTION.

 

This Final Office Action is written in response to the applicant’s response to office action letter dated June 06, 2009.  The examining attorney has reviewed the applicant’s response and accepted all but the following. 

 

The following requirements are now made FINAL:  Insufficient Fees.  See37 C.F.R. §2.64(a).

 

Requirements for Multi-Class Application:

 

In the applicant’s response, the applicant added two International Classes to the application.  The applicant did not, however, submit the required fees for the additional classes as specified in the outgoing office action on December 30, 2008.  Therefore, the applicant must adhere to the following:

 

If applicant prosecutes this application as a combined, or multiple-class application, then applicant must comply with each of the following for those goods and/or services based on an intent to use the mark in commerce under Trademark Act Section 1(b):

 

(1)     Applicant must list the goods and/or services by international class; and

 

(2)     Applicant must submit a filing fee for each international class of goods and/or services not covered by the fee already paid (current fee information should be confirmed at http://www.uspto.gov).

Options:

 

If applicant does not respond within six months of the mailing date of this final Office action, the application will be abandoned.  15 U.S.C. §1062(b); 37 C.F.R. §2.65(a).  Applicant may respond to this final Office action by: 

 

(1)     Submitting a response that fully satisfies all outstanding requirements, if feasible; and/or

 

(2)     Filing an appeal to the Trademark Trial and Appeal Board, with an appeal fee of $100 per class.
