The assigned examining attorney has reviewed the referenced application and determined the following.

 

CURRENT IDENTIFICATION OF GOODS INDEFINITE

 

The current identification of goods is unacceptable because the term “backpack hydration system” is indefinite.  The applicant must indicate the specific nature of the goods.  Also, the applicant has identified goods classified in more than one class.  Therefore, the applicant must either add a class to the application or delete goods classified in more than one class.  The applicant may amend the identification, if accurate, to:

 

1.      Sports bags, backpacks.  (Class 18)

 

2.      Personal fluid hydration systems comprising a fluid reservoir, a delivery tube, a mouthpiece and a carrying pack.  (Class 21)

 

TMEP §1402.01.

 

Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.

ADDITION OF CLASSES TO THE APPLICATION

(1)   Applicant must list the goods and/or services by international class with the classes listed in ascending numerical order; and

 

(2)   Applicant must submit a filing fee for each international class of goods and/or services not covered by the fee already paid (current fee information should be confirmed at http://www.uspto.gov).
