The examining attorney has reviewed the referenced application and has determined the following.
Search Deferred
The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d) at this time. TMEP §704.02. The examining attorney may conduct another search based on the information provided in response to this action.
Translation/Significance Inquiry
The applicant must indicate whether the proposed mark has any significance in the relevant trade, any geographical significance or any meaning in a foreign language. 37 C.F.R. Section 2.61(b).
Recitation of Services
The wording used in the recitation of services is too broad because it could include services classified in different international classes. The applicant may amend the identification to substitute the following wording, if accurate:
Geospatial data compiling and analyzing relating to business management, preparing geospatial data business reports in Class 35.
-and/or-
Providing temporary use of on-line non-downloadable interactive software for managing, searching, and sorting geospatial data in Class 42.
-and/or-
Licensing of intellectual property, namely, geospatial data reports to others in Class 45. TMEP Section 1402.01 and 1402.03(a).
Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted. 37 C.F.R. §2.71(a); TMEP §1402.06. Therefore, the applicant may not amend to include any goods or services that are not within the scope of the goods and services recited in the present identification.
If applicant prosecutes this application as a combined, or multiple-class application, applicant must comply with each of the following for those goods and/or services based on an intent to use the mark in commerce under Trademark Act Section 1(b):
(1) Applicant must list the goods and/or services by international class with the classes listed in ascending numerical order; and
(2) Applicant must submit a filing fee for each international class of goods and/or services not covered by the fee already paid (current fee information should be confirmed at http://www.uspto.gov).
