The assigned examining attorney has reviewed the referenced application and determined the following.

 

CLASSIFICATION/IDENTIFICATION OF GOODS

 

The application identifies goods and/or services that are classified in two classes; however, the fees submitted are sufficient to cover one class(es) only. 

 

Applicant must either:  (1) restrict the application to the number of class(es) covered by the fee(s) already paid, or (2) submit the fees for the additional class(es). 

 

If applicant submits the outstanding fees with a paper response, then applicant must submit $375 to cover the fees for the remaining class(es).  However, if applicant submits the fees in a response filed via the Trademark Electronic Application System (TEAS), then applicant must submit $325 to cover the fees for the remaining class(es).  37 C.F.R. §§2.6 and 2.86(a)(2); TMEP §§810, 1401.04, 1401.04(b) and 1403.01.

             

 

The identification of goods is unacceptable as indefinite.     The applicant may adopt the following, if accurate:

sauces, seasonings and spices; mixes for sauces, mixes for bakery goods; bakery goods; candies and sweets; prepared and packaged entrees http://atlas/netacgi/ - h2http://atlas/netacgi/ - h4 consisting primarily of pasta or rice; prepared pasta; coffee and teas, in class 30

 

Soup mixes, in Class 29.

If the name in the mark identifies a particular living individual, then applicant must submit the following: 

 

(1)   a signed, written consent from that individual, authorizing applicant to register the name as a trademark with the USPTO; and

 

(2)   a statement that “CURTIS STONE identifies a living individual whose consent is of record.”
