The applicant, Aloe Vera of America, Inc., having an address of 13745 Jupiter Road, Dallas, Texas United States 75238, requests a six-month extension of time to file the Statement of Use under 37 C.F.R. Section 2.89 in this application.    The Notice of Allowance mailing date was 07/17/2007.

For International Class 003:

The applicant has a continued bona fide intention to use or use through the applicant's related company or licensee the mark in commerce on or in connection with all of the goods and/or services listed in the Notice of Allowance or as subsequently modified for this specific class.


For International Class 005:
Current identification: dietary and nutritional food supplements in tablet, capsule, liquid and powdered form; meal replacement and energy supplements, namely nutritional energy bars, meal replacement bars, and meal replacement shake mixes; multi-vitamin and mineral supplements for adults and for children; topical skin care preparations, namely, first aid spray containing aloe vera for temporary relief from minor cuts, scratches, skin abrasions, and sunburn; topical veterinary preparation for skin and coat for temporary relief from minor irritation

The applicant has a continued bona fide intention to use or use through the applicant's related company or licensee the mark in commerce on or in connection with all of the goods and/or services listed in the Notice of Allowance or as subsequently modified for this specific class.

The applicant has a continued bona fide intention to use or use through the applicant's related company or licensee the mark in commerce on or in connection with all of the goods and/or services listed in the Notice of Allowance or as subsequently modified for this specific class.


For International Class 031:
Current identification: fresh crops, namely, live aloe vera plants and harvested aloe vera leaves

The applicant has a continued bona fide intention to use or use through the applicant's related company or licensee the mark in commerce on or in connection with all of the goods and/or services listed in the Notice of Allowance or as subsequently modified for this specific class.


For International Class 032:
Current identification: aloe vera juice, aloe vera juice and aloe vera gel drinks containing pulp; aloe vera juice mixed with fruit juice(s); and bottled spring water

The applicant has a continued bona fide intention to use or use through the applicant's related company or licensee the mark in commerce on or in connection with all of the goods and/or services listed in the Notice of Allowance or as subsequently modified for this specific class.


This is the second extension request.   The applicant has made the following ongoing efforts to use the mark in commerce on or in connection with each of those goods and/or services covered by the extension request: product or service research development


A fee payment in the amount of $750 will be submitted with the form, representing payment for 5 classes.
