The assigned examining attorney has reviewed the referenced application and determined the following.

Search:

The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

Recitation of Services:

 

The wording “volunteer services, namely, testing therapy dogs and providing therapy dogs and handlers to hospitals, nursing homes and institutions for the purpose of providing companionship and comfort to patients” as used by the applicant is too indefinite and too broad. The applicant must clarify what it is they testing for.  For example, is the applicant testing the dogs for health that is in class 44, testing for knowledge of what to do – that would probably be in 41. Providing the dogs to hospitals, etc. would actually be in 45 since it's for companionship and comfort and not for any kind of therapy- that would be in 44.

Additions to Identification Not Permitted
