The assigned trademark examining attorney has reviewed the referenced application and has determined the following:

 

2(e)(4) - Surname Refusal

 

Registration is refused because the proposed mark is primarily merely a surname.  Trademark Act Section 2(e)(4), 15 U.S.C. §1052(e)(4); TMEP §§1211 et seq.  The primary significance of the mark to the purchasing public determines whether a term is primarily merely a surname.  In re Etablissements Darty et Fils, 759 F.2d 15, 225 USPQ 652, 653 (Fed. Cir. 1985); In re Kahan & Weisz Jewelry Mfg. Corp., 508 F.2d 831, 184 USPQ 421 (C.C.P.A. 1975).

 

Please see the attached evidence from the Lexis Nexis database, establishing the surname significance of the surname BECK.  This evidence shows the proposed mark appearing 45,734 times as a surname in a nationwide telephone directory of names and provides the first 100 results.

 

The following five factors are used to determine whether a mark is primarily merely a surname:

 

  • the rareness of the surname;
  • whether anyone connected with the applicant has the mark as his or her surname;
  • whether the term has any recognized meaning other than as a surname;
  • whether the mark has the structure and pronunciation of a surname; and
  • whether the mark is sufficiently stylized to remove its primary significance from that of a surname.

 

TMEP §1211.01.  See In re Benthin Management GmbH, 37 USPQ2d 1332, 1333-1334 (TTAB 1995); In re Sava Research Corp., 32 USPQ2d 1380 (TTAB 1994) and cases cited therein.

 

In view of the above, registration is refused under Section 2(e)(4) of the Trademark Act on the basis that the mark is primarily merely a surname.

 

Section 2(d) - Likelihood of Confusion Refusal – LIMITED TO CLASSES 35 AND 42

 

Registration of the proposed mark is refused because of a likelihood of confusion with the mark in U.S. Registration No. 2735782.  Trademark Act Section 2(d), 15 U.S.C. §1052(d); TMEP §§1207.01 et seq.  See the enclosed registration.

 

A likelihood of confusion determination involves a two-part analysis.  First, the marks are compared for similarities in appearance, sound, connotation and commercial impression.  In re E .I. du Pont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973).  Second, the goods or services are compared to determine whether they are similar or related or whether the activities surrounding their marketing are such that confusion as to origin is likely.  In re National Novice Hockey League, Inc., 222 USPQ 638 (TTAB 1984); In re August Storck KG, 218 USPQ 823 (TTAB 1983); In re Int’l Tel. and Tel. Corp., 197 USPQ 910 (TTAB 1978); Guardian Prods. Co., v. Scott Paper Co., 200 USPQ 738 (TTAB 1978); TMEP §§1207.01 et seq.

 

Comparison of the Marks

 

Applicant’s mark is BECK.  Registrant’s mark is BECK AG COM INCORPORATED.  Applicant’s mark is confusingly similar to the dominant and recognizable portion of registrant’s mark, i.e., BECK.

 

When a mark consists of a word portion and a design portion, the word portion is more likely to be impressed upon a purchaser’s memory and to be used in calling for the goods or services.  Therefore, the word portion is normally accorded greater weight in determining likelihood of confusion.  In re Dakin’s Miniatures Inc., 59 USPQ2d 1593, 1596 (TTAB 1999); In re Appetito Provisions Co., 3 USPQ2d 1553 (TTAB 1987); Amoco Oil Co. v. Amerco, Inc., 192 USPQ 729 (TTAB 1976); TMEP §1207.01(c)(ii).  As such, here, the word portion of registrant’s mark is given greater weight.

 

In addition, disclaimed matter is typically less significant or less dominant when comparing marks.  Although a disclaimed portion of a mark certainly cannot be ignored, and the marks must be compared in their entireties, one feature of a mark may be more significant in creating a commercial impression.  In re Dixie Restaurants Inc., 105 F.3d 1405, 41 USPQ2d 1531 (Fed. Cir. 1997); In re National Data Corporation, 753 F.2d 1056, 224 USPQ 749 (Fed. Cir. 1985); and In re Appetito Provisions Co. Inc., 3 USPQ2d 1553 (TTAB 1987).  See also Hewlett-Packard Co. v. Packard Press Inc., 281 F.3d 1261, 62 USPQ 2d 1001 (Fed. Cir. 2002); Tektronix, Inc. v. Daktronics, Inc., 534 F.2d 915, 189 USPQ 693 (C.C.P.A. 1976); In re El Torito Rests. Inc., 9 USPQ2d 2002 (TTAB 1988); In re Equitable Bancorporation, 229 USPQ 709 (TTAB 1986).  As such, here, the disclaimed wording AG and INCORPORATED in registrant’s mark is given less weight.

 

Comparison of the Services

 

The goods and/or services of the parties need not be identical or directly competitive to find a likelihood of confusion.  Instead, they need only be related in some manner, or the conditions surrounding their marketing are such that they would be encountered by the same purchasers under circumstances that would give rise to the mistaken belief that the goods and/or services come from a common source.  On-line Careline Inc. v. America Online Inc., 229 F.3d 1080, 56 USPQ2d 1471 (Fed. Cir. 2000); In re Martin’s Famous Pastry Shoppe, Inc., 748 F.2d 1565, 223 USPQ 1289 (Fed. Cir. 1984); In re Melville Corp., 18 USPQ2d 1386, 1388 (TTAB 1991); In re Corning Glass Works, 229 USPQ 65 (TTAB 1985); In re Rexel Inc., 223 USPQ 830 (TTAB 1984); Guardian Prods. Co., Inc. v. Scott Paper Co., 200 USPQ 738 (TTAB 1978); In re Int’l Tel. & Tel. Corp., 197 USPQ 910 (TTAB 1978); TMEP §1207.01(a)(i).

 

Applicant’s relevant services are  “advertising and promotion services and related consulting” in Class 35 and “design for others in the fields of advertising/promotion/packaging for: food, clothing, entertainment, beverages, recreation, etc; design of homepages and websites; packaging design for others; providing an on-line computer database in the field of advertising and/or promotion used to catalog and store digital assets (images, logos, layout files, etc.) in Class 42.  Registrant’s services are business marketing consulting services.

 

A determination of whether there is a likelihood of confusion is made solely on the basis of the goods and/or services identified in the application and registration, without limitations or restrictions that are not reflected therein.  In re Dakin’s Miniatures Inc., 59 USPQ2d 1593, 1595 (TTAB 1999).  If the cited registration describes the goods and/or services broadly and there are no limitations as to their nature, type, channels of trade or classes of purchasers, then it is presumed that the registration encompasses all goods and/or services of the type described, that they move in all normal channels of trade, and that they are available to all potential customers.  In re Linkvest S.A., 24 USPQ2d 1716 (TTAB 1992); In re Elbaum, 211 USPQ 639 (TTAB 1981); TMEP §1207.01(a)(iii).  The attached evidence provides definitions of the terms “marketing” and “consulting” which illustrate the similarity of the respective services of the parties.  Essentially, the services of both registrant and applicant help product manufacturers move their products from production to market.

 

Moreover, any goods or services in the registrant’s normal fields of expansion must also be considered in order to determine whether the registrant’s goods or services are related to the applicant’s identified goods or services for purposes of analysis under Section 2(d).  In re General Motors Corp., 196 USPQ 574 (TTAB 1977).  The test is whether purchasers would believe the product or service is within the registrant’s logical zone of expansion.  CPG Prods. Corp. v. Perceptual Play, Inc., 221 USPQ 88 (TTAB 1983); TMEP §1207.01(a)(v).

 

Any doubt regarding a likelihood of confusion is resolved in favor of the prior registrant.  Hewlett-Packard Co. v. Packard Press Inc., 281 F.3d 1261, 62 USPQ2d 1001, 1004 (Fed. Cir. 2002); In re Hyper Shoppes (Ohio), Inc., 837 F.2d 463, 6 USPQ2d 1025 (Fed. Cir. 1988); TMEP §§1207.01(d)(i).

 

THIS REFUSAL APPLIES TO CLASSES 35 and 42 ONLY.

 

The stated refusal refers to Classes 35 and 42 only and does not bar registration in the other classes.

 

Applicant may respond to the stated refusal by doing one of the following:

 

(1)   deleting the classes to which the refusal pertains;

 

(2)   arguing against the refusal of the combined application as a whole;

 

(3)   filing a request to divide out the goods and/or services that have not been refused registration, so that the mark may be published for opposition in the classes to which the refusal does not pertain (See 37 C.F.R. §2.87 and TMEP §§1110.05 and 1403.03 regarding the requirements for filing a request to divide); or

 

(4)   changing the basis, if appropriate (the basis may not be changed for applications filed under Trademark Act §66(a)).

 

Prior Pending Application

 

Information regarding pending Application Serial No. 78962850 is enclosed.  The effective filing date of the referenced application precedes applicant’s filing date.  There may be a likelihood of confusion between the two marks under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  If the referenced application registers, registration may be refused in this case under Section 2(d).  37 C.F.R. §2.83; TMEP §§1208 et seq.  Therefore, upon entry of a response to this Office action, action on this case may be suspended pending final disposition of the earlier-filed application.

 

If applicant believes there is no potential conflict between this application and the earlier-filed application, then applicant may present arguments relevant to the issue in a response to this Office action.  The election not to submit arguments at this time in no way limits applicant’s right to address this issue at a later point.

 

If applicant chooses to respond to the refusals to register, then applicant must also respond to the following requirements.

 

Identification of Goods

 

Certain wording in the identification of services for Classes 40 and 42 needs clarification because it is indefinite.   Applicant must clarify the identification of goods by deleting the terms “etc.” and “and/or”.  TMEP §1402.01.  Applicant must also remove any parentheses from the identification of services and incorporate the parenthetical information into the description.  Generally, parentheses and brackets should not be used in identifications.  Parenthetical information is only permitted in identifications if it serves to explain or translate the matter immediately preceding the parenthetical phrase in such a way that it does not affect the clarity of the identification, e.g., “obi (Japanese sash).”  TMEP §1402.12.  Finally, it appears that certain of the services identified in Class 40 should be reclassified in International Class 42.  Applicant may change the identifications to the wording proposed below, if accurate.  TMEP §1402.01.

 

Class 40:  Color enhancement of black and white film; Color separation services, creating files and readying images for print reproduction [amend to “color separation services, namely, creating files and readying images for print reproduction”]; Creating production art for graphics applications and print reproduction [amend to “graphic illustration for others” OR “graphic art design” (properly classified in Class 42); Digital enhancement of photographs; Electronic digitizing of photographs into a computer readable media; Electronic imaging, scanning, digitizing, alteration and/or [must amend to “and” for clarification purposes] retouching of photographic images [and] artwork; Film developing and processing;  Offset printing coordinated through purchases from outside vendors [parentheses removed]; Photographic computer imaging, [namely,] digital illustration and photographic retouching [slash marks removed].

 

Class 42:  Application service provider  featuring software in the field of electronic image database management; Computer aided design for others; Computer graphics services; Computer services, namely, acting as an application service provider in the field of knowledge management to host computer application software for the collection, editing, organizing, modifying, book marking, transmission, storage and sharing of data and information; Consulting services in the field of graphics reproduction, digital asset management services, workflow systems, and consumer product design and related packaging production workflows; Computer services in the nature of customized web pages featuring user-defined information, personal profiles and information; Design, creation, hosting, and maintenance of websites for others; Design for others in the fields of advertising/promotion/packaging for: food, clothing, entertainment, beverages, recreation [clarify nature of design services; may amend to “design for others in the fields of advertisement, promotional materials and packaging in the fields of …”]; Design of packaging and wrapping materials; Design of homepages and websites; Graphic art design and conception [delete “and conception”]; Graphic design services for others; Graphic illustration services for others; Packaging design for others; Providing an on-line computer database in the field of advertising and/or promotion used to catalog and store digital assets,[namely,] images, logos, [and] layout files [parentheses removed]; Technology consultation in the technology field of graphics reproduction and electronic asset database management.

 

In the identification of goods, applicant must use the common commercial or generic names for the goods, be as complete and specific as possible, and avoid the use of indefinite words and phrases.
