The assigned examining attorney has reviewed the referenced application and determined the following.

 

The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

Identification of Goods

The identification of goods is unacceptable because the applicant must: 1.) specify the field of use of its catalogs; 2.) specify the material composition/nature of its boxes; 3.) specify the material composition of its hang tags.  The applicant may adopt the following identification, if accurate: Boxes namely, [specify material composition, i.e. metal boxes], in International Class 6.

 

Catalogs in the field of [indicate specific field of use, i.e. clothing, gardening], paper for catalogs, stationery, envelopes, notepaper and notepads, boxes namely, [specify material composition, i.e. cardboard boxes, paper boxes or types of boxes, i.e. pencil boxes, stationery boxes] and hang tags namely, [specify material composition, i.e. cardboard hang tags, paper hang tags], in International Class 16.

 

Hang tags namely, [specify material composition, i.e. plastic hang tags]; boxes namely, [specify material composition, i.e. plastic boxes], in International Class 20.”  TMEP §1402.01.

 

Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.

Classification

If applicant adopts the suggested amendment of the goods, then applicant must amend the classification to International Classes 6, 16 and 20.  37 C.F.R. §§2.32(a)(7) and 2.85; TMEP §§1401 et seq.

 

 

Requirements of Combined or Multiple-Class Applications

If applicant prosecutes this application as a combined, or multiple-class application, applicant must comply with each of the following for those goods an intent to use the mark in commerce under Trademark Act Section 1(b):

 

(1)   Applicant must list the goods by international class with the classes listed in ascending numerical order; and

 

(2)   Applicant must submit a filing fee for each international class of goods not covered by the fee already paid (current fee information should be confirmed at http://www.uspto.gov).

Disclaimer

The applicant must disclaim the descriptive wording “WOOD FREE PAPER” apart from the mark as shown. Trademark Act Section 6, 15 U.S.C. §1056; TMEP §§1213 and 1213.03(a).  The wording is merely descriptive because the applicant’s goods are likely to be made from “wood free paper.”  (See attached)

 

The computerized printing format for the Office’s Trademark Official Gazette requires a standardized format for a disclaimer.  TMEP §1213.08(a)(i).  The following is the standard format used by the Office:
