TO AVOID ABANDONMENT, THE OFFICE MUST RECEIVE A PROPER RESPONSE TO THIS OFFICE ACTION WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE.
Upon further consideration, the examining attorney raises the following issue(s):
If applicant should fail to respond to this Office action within the six month time limit, then the following goods/services will be deleted from the application: “PROVIDING CONSULTATION AND INFORMATION IN THE FIELD OF EMERGENCY EVACUATION AND TRANSPORATION OF PASSENGERS BY BUS” in International Class 39. The application will then proceed forward for the remainder of the goods and/or services only. 37 C.F.R. §2.65(a).
Recitation of Services
The wording “PROVIDING CONSULTATION AND INFORMATION IN THE FIELD OF EMERGENCY EVACUATION AND TRANSPORTATION BY BUS” in the identification of services needs clarification because the field “emergency evacuation” is too broad and could include services classified in other international classes.
Applicant may maintain International Class 39 and amend to the following wording, if accurate: providing consultation and information in the field of emergency evacuation transportation by bus. TMEP §§1402.01 and 1402.03.
The applicant may add International Class 35 and add the following wording: providing logistics services in the field of emergency evacuation and transportation by bus, in International Class 35. See below for adding classes.
For assistance with identifying goods and/or services in trademark applications, please see the online searchable Manual of Acceptable Identifications of Goods and Services at http://tess2.gov.uspto.report/netahtml/tidm.html.
Please note that, while the identification of services may be amended to clarify or limit the services, adding to the services or broadening the scope of the services is not permitted. 37 C.F.R. §2.71(a); TMEP §1402.06. Therefore, applicant may not amend the identification to include services that are not within the scope of the services set forth in the present identification.
Additional Class – Intent to Use
If applicant prosecutes this application as a combined, or multiple-class application, then applicant must comply with each of the following for those goods and/or services based on an intent to use the mark in commerce under Trademark Act Section 1(b):
(1) Applicant must list the goods and/or services by international class with the classes listed in ascending numerical order. TMEP § 1403.01; and
(2) Applicant must submit a filing fee for each international class of goods and/or services not covered by the fee already paid (current fee information should be confirmed at http://www.uspto.gov). 37 C.F.R. §2.86(a)(2); TMEP §§810 and 1403.01.
If applicant has questions about its application or needs assistance in responding to this Office action, please telephone the assigned trademark examining attorney directly at the number below.
