In the February 20, 2007 Office Action, the examiner refused registration because of a likelihood of confusion with the mark SKYTEL in U.S. Reg. No. 2,827,789. The Office Action also instructed that, if the cited registration has been assigned to applicant, applicant should ntoify the examiner when the assignment has been recorded. On April 27, 2007, an assignment was recorded assigning the cited registration to applicant. The assignment was recorded at Reel/Frame 3530/0893. A copy of the Trademark Assignment Details report for Reel 3530 Frame 0893 is attached. Applicant respectfully submits that, in light of the assignment, the refusal to register should be withdrawn. The Office Action also requests applicant submit a claim of ownership for other prior registrations. Applicant is the owner of U.S. Reg. Nos. 1775044, 2111125 and 2444842. Applicant has addressed each of the points set forth in the February 20, 2007 Office Action and respectfully requests that its UNPLUGGEDCITY BY SKYTEL mark be registered. |
