The following were discussed in communication with Morgan M. Bowers on February 13, 2007. Applicant must respond to each refusal and/or requirement raised below.
The wording “Photovoltaic solar systems; power inverters; and solar HVAC system components, namely evacuated solar tube heating systems, solar air conditioning units, solar powered fans and water pumps, heat exchangers and storage tanks” in the identification of goods needs clarification because it is too broad and could include goods classified in other international classes. TMEP §§1402.01 and 1402.03. For example, in general, ”solar systems“ and “power inverters” are classified in International Class 009. In addition, the word “system” in the identification of goods is indefinite and must be amended to list the major parts or components of the system, as well as describe the nature, purpose and use of the system. Applicant should use common generic terms when specifying the parts or components of the system. TMEP §1402.03. If applicant chooses to use indefinite terms such as "accessories," "components," "devices," "equipment," "materials," "parts," "systems" and "products," then such terms must be followed by the word "namely" and a list of the specific goods identified by their common commercial or generic names. TMEP §§1402.01 and 1402.03(a).
Applicant may adopt the following identification of goods, if accurate:
“Photovoltaic solar systems consisting of {specify, e.g., photovoltaic solar modules, voltage regulators, controllers, inverters and wiring, etc.}; Power inverters.”
“Photovoltaic solar systems, namely, {specify, e.g., solar collectors, solar heat collection panels}; Solar HVAC systems comprised of evacuated solar heating tubes, solar air conditioning units; solar powered fans and water pumps, heat exchangers and storage tanks.”
As noted above, applicant classified “solar systems” and “power inverters” in International Class 011. As previously stated, “solar systems” could be classified in Int. Class 009 or 011 depending upon what the systems are comprised of. “Power inverters” are classified in Int. Class 009. Accordingly, applicant must either delete these goods or add International Class 009 to the application. 37 C.F.R. §§2.32(a)(7) and 2.85; TMEP §1401.04(b).

Please note that, while the identification of goods may be amended to clarify or limit the goods, adding to the goods or broadening the scope of the goods is not permitted. 37 C.F.R. §2.71(a); TMEP §1402.06. Therefore, applicant may not amend the identification to include goods that are not within the scope of the goods set forth in the present identification.
If applicant prosecutes this application as a combined, or multiple-class application, then applicant must comply with each of the following for those goods and/or services based on <an intent to use the mark in commerce under Trademark Act Section 1(b)/a foreign registration under Trademark Act Section 44(e)/an intent to use the mark in commerce under Trademark Act Section 1(b) and a foreign registration under Trademark Act Section 44(e)>:
(1) Applicant must list the goods and/or services by international class with the classes listed in ascending numerical order. TMEP § 1403.01; and
(2) Applicant must submit a filing fee for each international class of goods and/or services not covered by the fee already paid (current fee information should be confirmed at http://www.uspto.gov). 37 C.F.R. §2.86(a)(2); TMEP §§810 and 1403.01.
The filing fee for adding classes to an application is as follows:
(1) $325 per class, when the fees are submitted with a response filed online via the Trademark Electronic Application System (TEAS) at http://www.gov.uspto.report/teas/index.html; and
(2) $375 per class, when the fees are submitted with a paper response.

Applicant must submit an English translation of all foreign wording in the mark. 37 C.F.R. §2.61(b); TMEP §809. The examining attorney suggests the following, if accurate: “the terms “SOL” and “AQUA” translate as “sun” and “water” but the composite has no meaning in a foreign language.”
