GOODS
Applicant’s mark is NUHERBAL RELIEF for goods in Classes 1 and 5. With respect to Class 5, the applicant’s goods are various dietary, nutritional and herbal supplements. The registrant’s mark is NUHERB for the following in Class 5: food supplements, herbal teas for medicinal purposes; herbal supplements sold in pill, capsule and tablet forms. The respective goods are essentially the same.
MARKS
The marks NUHERBAL RELIEF and NUHERBS are similar. NUHERBAL, in the applicant’s mark is dominant because RELIEF is diluted and weak.
Applicant must respond to the requirement(s) set forth below.

No claim is made to the exclusive right to use “RELIEF” apart from the mark as shown.

Failure to comply with a disclaimer requirement can result in a refusal to register the entire mark. TMEP §1213.01(b).
A “disclaimer” is a statement that applicant does not claim exclusive rights to an unregistrable component of a mark. TMEP§1213. A disclaimer does not affect the appearance of the applied-for mark. See TMEP§1213.10.
The following cases further explain the disclaimer requirement: Dena Corp. v. Belvedere Int’l Inc., 950 F.2d 1555, 21 USPQ2d 1047 (Fed. Cir. 1991); In re Kraft, Inc., 218 USPQ 571 (TTAB 1983).
IDENTIFICATION OF GOODS
Applicant must clarify the identification of goods. See TMEP §1402.01.
"Oral preparations" are indefinite - what do they treat? What do they do? "Botanical extracts for use in nutraceuticals and pharmaceuticals" is indefinite - if "for use in the manufacture of nutraceuticals and pharmaceuticals," proper class is 1.
When applicant responds, applicant must rewrite the identification in its entirety for entry on the record,
