Sir or Madam,
The present divisional application is directed to “sweet dessert mixes namely, kheer mix namely rice pudding mix, firni khas namely rice pudding mix, ras malai mix being mix for milk balls in milk syrup, gulab jamun mix being mix for milk balls in sugar syrup, kulfa shahi mix being traditional ice cream mix, kulfi mix being traditional ice cream mix, gajar halwa mix being sweet carrots mix, custard powder, and jelly crystals” in International Class 29.
As previously discussed by the undersigned counsel for Applicant and the Examining Attorney, Applicant requests that the suspension of the present divisional application be lifted because the refusal to register Parent Application Serial No. 76584605 under Trademark Act Section 2(d), 15 U.S.C. § 1052(d), is inapplicable to the present application due to nature of the recited goods.
Applicant has successfully addressed all outstanding informalities—as noted in the Office Action dated November 30, 2005 issued in association with Parent Application Serial No. 76584605. Therefore, Applicant respectfully requests that the present application be approved for publication.
