Dear Director, We filed a transformation request on October 6, 2016 with respect to U.S. Registration No. 3268560 which was based on Int'l Registration No. 0887653. The U.S. registration was cancelled on July 7, 2016. We mistakenly believe that a transformation request was appropriate in this context. We received notice from the USPTO on January 17, 2017 that the request was accepted and a new serial number was granted, Ser. No. 76/720,087. We have been under the impression since then that our application was to proceed to examination and review. We were only recently made aware that the USPTO has now issued a transformation denial on April 14, 2017 because the USPTO made a mistake and should not have issued a serial number with respect to our transformation request. In light of the foregoing circumstances, we respectfully request that the USPTO keep this application alive, grant this petition, and retain the January 17, 2017 filing date because the application has been publically on record since January 17, 2017 for the public and no third party harm has been done. |
