EXAMINER’S AMENDMENT
APPLICATION HAS BEEN AMENDED: In accordance with the authorization granted by Robert Roomian on October 2, 2015, the trademark examining attorney has amended the application as indicated below. Please advise the undersigned immediately of any objections. Otherwise, no response is necessary. TMEP §707. Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.
Color Claim / Description of the Mark Statement
(1) The following amended color claim is hereby made of record:
The colors orange, blue and white are claimed as a feature of the mark.
(2) The following description of the mark statement is entered into the record:
The mark consists of the wording “THE GROUP” in large white lettering, with the phrase “AUTOMOTIVE PARTS SERVICES GROUP” appearing underneath in smaller white lettering. To the left of the wording are two parallel diagonal bars outlined in white, with the first being orange and the second blue in color. The wording and design elements all appear on a blue background. The rectangular shape is solely to show that the blue background area fully surrounds the wording and design elements, and is not a feature of the mark.
Disclaimer Statement
The following disclaimer statement is added to the record:
No claim is made to the exclusive right to use “THE GROUP” and “AUTOMOTIVE PARTS SERVICES GROUP” apart from the mark as shown.
The examining attorney appreciates the applicant’s assistance with regard to the above issues. Upon entry of these amendments into the Office’s database, this application will be immediately approved for publication.
