STRICT DEADLINE TO RESPOND TO THIS LETTER

TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.

The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

 

 

 

NO CONFLICTING MARKS

 

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

 

COLOR CLAIM IS INCOMPLETE

 

 

The color claim does not identify all the colors in the drawing of the mark.  Specifically, the following color has been omitted:  white.  A complete color claim must list all the colors appearing in the drawing of the mark.  See 37 C.F.R. §2.52(b)(1); TMEP §§807.07(a) et seq.  If black, white, and/or gray are not being claimed as a color feature of the mark, applicant must exclude these from the color claim and include in the mark description a statement that the colors black, white, and/or gray represent background, outlining, shading and/or transparent areas and are not part of the mark.  TMEP §807.07(d). 

 

Based on the foregoing requirements for a complete color claim, applicant must provide a color claim that references all of the colors appearing in the drawing of the mark.  See 37 C.F.R. §2.52(b)(1); TMEP §§807.07(a) et seq.

 

Additionally, instead of “blue lagoon” the applicant should use common terminology to describe that color, such as “medium blue.”

 

The following color claim is suggested:  The colors midnight blue, medium blue, white and light green are claimed as a feature of the mark.

 

 

 

DESCRIPTION OF THE MARK

 

 

The description of the mark should make reference to the color medium blue instead of the color blue lagoon.  See 37 C.F.R. §2.37; TMEP §§808 et seq. 

 

Therefore, applicant must provide an amended description of the applied-for mark.  The following is suggested:

 

THE MARK CONSISTS OF THE LETTER "S" IN MIDNIGHT BLUE, THE LETTER "B" IN MEDIUM LAGOON AND THE LETTER "E" IN LIGHT GREEN CENTERED IN A WHITE CIRCLE WITH THREE PARTIAL MOON-SHAPED CIRCLES SURROUNDING THE WHITE CIRCLE IN THE COLORS MIDNIGHT BLUE, MEDIUM BLUE AND LIGHT GREEN.

 

 

Applicant is encouraged to telephone or e-mail the assigned trademark examining attorney to resolve the issues raised in this Office action by examiner’s amendment.  Although the USPTO will not accept a formal response by e-mail, an applicant may communicate informally by phone or e-mail with the trademark examining attorney to agree to a proposed amendment to the application that will immediately place the application in condition for publication for opposition, issuance of a registration, or suspension.  See 37 C.F.R. §2.62(c); TMEP §707.
