OFFICE ACTION
TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.
ISSUE/MAILING DATE: 5/22/2014
The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
SUMMARY OF ISSUES that applicant must address:
· Identification and Classification of Goods
· Multiple Class Instructions
IDENTIFICATION AND CLASSIFICATION OF GOODS
The following wording in the identification of goods is indefinite and must be clarified:
“crockery wares made of ceramic for household use” (applicant must indicate the particular item by its common commercial name); “ceramic cookwares” (applicant must indicate the specific item by its common commercial name); “kettles” (applicant must indicate whether the kettles or electric or non-electric and classify accordingly); “fondue pots” (applicant must indicate the type of fondue pot and classify accordingly); “frying fans” (applicant may have intended “frying pans,” which have to be classified according to type, e.g., electric or non-electric); and “storage containers” (applicant must indicate the type of container and/or use) See TMEP §1402.01.
Applicant may amend to adopt the following, if accurate:
International Class 11:
· Electric kettles and fondue pots with heat source.
International Class 21:
· Crockery, namely, pots, dishes, drinking cups and saucers, bowls, serving bowls and trays; cookware, namely, {indicate types of cookware}; non-electric kettles, cooking pots, fondue pots without heat source; frying pans, bowls, plastic storage containers for household use; bakewares made of ceramic.
International Class 29:
· Cheese fondue
International Class 30:
An applicant may only amend an identification to clarify or limit the services, but not to add to or broaden the scope of the services. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.
For assistance with identifying and classifying goods and services in trademark applications, please see the USPTO’s online searchable U.S. Acceptable Identification of Goods and Services Manual at http://tess2.gov.uspto.report/netahtml/tidm.html. See TMEP §1402.04.
MULTIPLE CLASS INSTRUCTIONS
(1) List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.
(2) Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule at http://www.gov.uspto.report/trademarks/tm_fee_info.jsp). The application identifies goods and/or services that are classified in at least four classes; however, applicant submitted a fee(s) sufficient for only one class(es). Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.
See 15 U.S.C. §§1051(b), 1112, 1126(e); 37 C.F.R. §§2.32(a)(6)-(7), 2.34(a)(2)-(3), 2.86(a); TMEP §§1403.01, 1403.02(c).
