OFFICE ACTION
TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.
ISSUE/MAILING DATE: 10/3/2013
This Office action is in response to applicant’s communication filed on September 23, 2013.
The following requirement has been satisfied: Substitute Specimen. TMEP §§713.02, 714.04.
Upon further review, the following issue arose. The examining attorney apologizes for any inconvenience this may cause.
The applied-for mark is not in standard characters and applicant did not provide a description of the mark with the initial application. Applications for marks not in standard characters must include an accurate and concise description of the entire mark that identifies literal elements as well as any design elements. See 37 C.F.R. §2.37; TMEP §§808.01, 808.02, 808.03(b).
Therefore, applicant must provide a description of the applied-for mark. The following is suggested:
The mark consists of a graphic of a three dimensional box laying on its side corner so that the top appears in a diamond shape on the left side. Part of the side of the box is missing and in this space is the term “Unicore”.
IDENTIFICATION OF GOODS – MAINTAINED AND CONTINUED
The wording “accessories” in the identification of goods must be clarified because it is too broad and could include goods in other international classes. See TMEP §§1402.01, 1402.03.
In the identification of goods, applicant must use the common commercial or generic names for the goods, be as complete and specific as possible, and avoid the use of indefinite words and phrases. TMEP §1402.03(a). If applicant uses indefinite words such as “accessories,” “apparatus,” “components,” “devices,” “equipment,” “materials,” “parts,” “systems,” or “products,” such words must be followed by “namely,” followed by a list of the specific goods identified by their common commercial or generic names. See TMEP §§1401.05(d), 1402.03(a).
Applicant may substitute the following wording, showing the suggested amendments in bold type, if accurate:
Class 9
Automation components, namely, electronic sensors, switches, sockets, relays, connectors and structural accessories therefor; instrumentation, namely, electronic sensors, switches, sockets, relays, connectors and structural accessories therefor; automation equipment, namely, electronic sensors, switches, sockets, relays, connectors and structural accessories therefor; semiconductor devices; and electronic communication products, namely, electronic sensors, switches, sockets, relays, connectors and structural accessories therefor
An applicant may amend an identification of goods and services only to clarify or limit the goods and services; adding to or broadening the scope of the goods and/or services is not permitted. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.
For assistance with identifying and classifying goods and/or services in trademark applications, please see the USPTO’s online searchable U.S. Acceptable Identification of Goods and Services Manual at http://tess2.gov.uspto.report/netahtml/tidm.html. See TMEP §1402.04.
