The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issues below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).

Requirement: Description of the Mark
Therefore, applicant must provide a description of the applied-for mark. The following is suggested:
The mark is not in color. The mark consists of the Greek lower case letter Mu “µ”, followed by the upper case Latin letter “P”, followed by the design of an upward pointing needle with the top tip bent leftward, followed by the lower case Latin letters “PETS”, from left to right.
Requirement: Identification of Goods
The goods are: “tools for manipulating, holding, transferring and denuding human gametes or embryos for assisted hatching; and for intracytoplasmic sperm injection (ICS I); and other assisted reproduction in vitrofertilization procedures”
The identification of goods is indefinite and must be clarified. See TMEP §1402.01. Applicant must specify the common commercial or generic name for the goods. If there is no common commercial or generic name, applicant must describe the product and intended consumer as well as its main purpose and intended uses.
The examining attorney notes that the specimen of record refers to “Injection ICSI”; therefore the examining attorney includes “Injection needles for medical use” in his suggestion below.
If accurate, applicant may adopt the following formulation for drafting an acceptable identification. The suggested language has been bolded for applicant’s convenience.
Class 010: [Specify tools by common commercial name in International Class 010, e.g. Injection needles for medical use, Needles for medical purposes] for manipulating, holding, transferring and denuding human gametes or embryos for assisted hatching, for intracytoplasmic sperm injection (ICS I) and for other assisted reproduction in-vitro fertilization procedures

Requirement: Explanation of the Mark’s Significance
Applicant must explain whether “µPLpets” has any meaning or significance in the industry in which the goods are manufactured/provided, or if such wording is a “term of art” within applicant’s industry. Applicant must also explain whether this wording identifies a geographic place. See 37 C.F.R. §2.61(b); TMEP §814.
Further, applicant must provide additional information about this wording to enable proper examination of the application. Specifically, applicant must respond to the following questions:
