The petition to revive the above identified trademark application submitted on March 11, 2016 is denied pursuant to Trademark Rule 2.66. The application remains abandoned.
The petition is denied for the following reason.
The 36-month period for filing a statement of use has expired. On December 21, 2015, the Intent to Use unit issued a letter explaining the late statement of use and refunded the $100 processing fee. The Director will not grant a petition to revive if this would permit the filing of a statement of use more than 36 months after the mailing date of the notice of allowance. 15 U.S.C. §1051; 37 C.F.R. §2.66. The notice of allowance for this application issued on December 18, 2012 and no statement of use was filed by December 21, 2015.
Applicant may file a new application. The United States Patent and Trademark Office recommends that new applications be filed using the Trademark Electronic Application System (TEAS), available over the Internet at http://www.gov.uspto.report/trademarks/teas/index.jsp.
