The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

 

APPLICATION HAS BEEN AMENDED 

 

The trademark examining attorney is amending the application as below detailed.  No prior approval or authorization from applicant or applicant’s attorney is required.  TMEP §707.02.

 

Please advise the undersigned immediately of any objections.  Otherwise, no response is necessary.  TMEP §707.  Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.

 

 

CLARIFICATION OF CLASSIFICATION AND IDENTIFICATION OF GOODS

 

The identification of goods is amended to delete the colon after “medical science” and before “namely.”  Additionally, although applicant did not identify a particular classification of the goods in its application, during preliminary review of the application, the Office incorrectly classified the goods in International Class 1.  The application is amended to properly classify the goods in International Class 5. 

 

Thus, the classification and identification of the goods is amended as follows: 

 

International Class 5

 

Chemicals for use in medical science, namely, fertility enhancement preparations for use in culturing and extended culturing of embryos; and diagnostic reagents for clinical and medical laboratory use.
