Applicant must respond to the following requirements.
IDENTIFICATION OF SERVICES
Applicant filed the following identification:
"INTERNET SUBMISSIONS FOR MODELS, MUSICIANS AND ACTORS OF THIER MATERIAL TO TALENT PROFESSIONALS"
In response to the examining attorney’s require for an amended identification the applicant submitted the following:
“Internet website that allows artists in the field of models, musicians, and actors to submit their material to entertainment professionals of their choice” in class 035
The wording in the amended identification of goods and/or services above is indefinite and must be clarified because the exact nature of the goods and/or services is unclear. See TMEP §§1402.01, 1402.03.
The following substitute identification with amended wording is suggested, if appropriate:
"Promotional services, namely, providing a website at which artists can showcase their talents via an online portfolio IN THE FIELD OF MODELS, MUSICIANS AND ACTORS" in Class 035
Identifications of goods and/or services can be amended only to clarify or limit the goods and/or services; adding to or broadening the scope of the goods and/or services is not permitted. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07. Therefore, applicant may not amend the identification to include goods and/or services that are not within the scope of the goods and/or services set forth in the present identification.

Proper Response to Final Action - Substantive Refusal or Requirement
