TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.
DATABASE SEARCH: The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
ISSUES APPLICANT MUST ADDRESS: On November 23, 2011, the trademark examining attorney and Edward D. Lanquist, Jr. discussed the issues below. Applicant must timely respond to these issues. See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §§708, 711.
The identification of goods is indefinite and must be clarified. See TMEP §1402.01. Applicant must specify the service purpose of “determining a candidate’s aptitude for success” through its “assessments, reports, and surveys.”
Applicant may adopt the following format for its identification of services, if accurate.
"{Specify, e.g., Career placement services}, namely, Conducting online assessments, reports, and surveys for the purpose of determining a candidate's aptitude for success in the field of church planters," in International Class 35.
Although identifications of goods and/or services may be amended to clarify or limit the goods and/or services, adding to or broadening the scope of the goods and/or services is not permitted. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07. Therefore, applicant may not amend the identification to include goods and/or services that are not within the scope of the goods and/or services set forth in the present identification.
