Identification of Goods

The identification of goods is indefinite and must be clarified because as written, the wording is too broad and must be specified for clarity.  See TMEP §1402.01.  Applicant may adopt the following identification, if accurate: 

 

Electrical and electronic circuits, component in the nature of [indicate the nature of the components, e.g., circuit boards, circuit breakers, circuit testers], semiconductors and packages therefore consisting primarily of [indicate the primary component of the packages therefore, e.g., electric and electronic circuits, electric circuit boards, electric circuit switches] and devices for power conversion, voltage conversion, power management and/or delivery of power, namely, [indicate specific type of devices for power conversion, voltage conversion, power management and/or delivery of power, e.g., electric power converters, electric power connectors, electrical power distribution units], in class 9. 

 

An applicant may amend an identification of goods only to clarify or limit the goods; adding to or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.

NOTICE OF IMPLEMENTATION OF THE NEW EDITION OF THE NICE AGREEMENT - CHANGES TO CLASSIFICATION APPLY TO APPLICATIONS FILED ON OR AFTER JANUARY 2, 2007:  Effective January 1, 2007, the Ninth Edition of the Nice Agreement brought about significant changes to the classification of certain goods and services.  All applications filed on or after January 2, 2007, must comply with the classification specified in the Ninth Edition.  TMEP §1401.10. 

 

For applications filed before January 2, 2007, compliance with the Ninth Edition is optional; and any such applicants who opt to follow the Ninth Edition must advise the assigned trademark examining attorney.  See TMEP §1401.11.  The Office’s online Acceptable Identifications of Goods and Services Manual, located at http://tess2.gov.uspto.report/netahtml/tidm.html, has been updated to reflect the classification changes in the Ninth Edition.  See TMEP §1402.04. 

 

Entity Omitted

Applicant must specify what type of entity is applying, e.g., an individual, partnership, corporation or joint venture.  See 37 C.F.R. §2.32(a)(3); TMEP §§803.03 et seq.

 

Citizenship Omitted

Applicant must specify his or her national citizenship for the record.  15 U.S.C. §1051(a)(2), (b)(2); 37 C.F.R. §2.32(a)(3)(i); TMEP §803.04.

 

Mark Description

Applicant must submit an accurate and concise description of the literal and design elements in the mark.  37 C.F.R. §2.37; see TMEP §§808.01, 808.02.  The following is suggested, if accurate:

 

The mark consists of the wording “COOLIR2BRIDGE” in stylized font with the letters “COOL,” “R,” and “B” are in uppercase, the letters “I” and “RIDGE” are in lowercase and the number 2 is a superscript.

 

Claim of Ownership of Prior Registration

If applicant is the owner of U.S. Registration No. 1551719, then applicant must submit a claim of ownership.  See 37 C.F.R. §2.36; TMEP §812.  The following standard format is suggested:
