Upon further review, the following has been determined concerning applicant’s identification of goods (TMEP §1402.01):
International Class 30: "Soy sauce based soup" is an International Class 29, not and International Class 30 good. All soups are properly classified in International Class 29.
International Class 32: "Soybean-based beverages; flavored soybean-based beverages" is indefinite. Applicant must indicate if these goods are used as a milk substitute. If so, they are properly placed in International Class 29. If the goods are not used as a milk substitute, the identification should be amended to so state so as to remain in International Class 32
