APPLICATION HAS BEEN AMENDED:  In accordance with the authorization granted by Philip R. Warn, Esq. on August 17, 2010, the trademark examining attorney has amended the application as indicated below.  Please advise the undersigned immediately of any objections.  Otherwise, no response is necessary.  TMEP §707.  Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.

 

Identification of Goods in International Class 1

The identification of goods in International Class 1 is amended to read as follows:  “Neutralizers used in the ophthalmic industry, namely, chemical product for neutralizing ophthalmic lens materials; heat transferors, namely, heat transferor fluids for industrial use; coolants for industrial use; defoamers for industrial use, namely, chemical additives for use in the manufacture of ophthalmic lenses; in International Class 1.”  See TMEP §§1402.01, 1402.01(e).

 

The identification of goods in International Classes 2 and 3 remains UNCHANGED.

 

The refusal under Section 2(d) of the Trademark Act is hereby withdrawn, and the present application will proceed to publication.
