THIS IS A FINAL ACTION.

 

This Office action is in response to applicant’s communication filed on March 8, 2010.

 

The applicant has submitted a new drawing, disclaimer and claim of ownership of U. S Registration 3,574,417 which have been entered in the record.

 

In the previous office action, the examining attorney required a new description of the mark and a color claim –all in the correct format.  See for example- The mark consists of the wording SPICY GRAVY in black and the color green appears in the basil leaves.

 

 

 If the applicant intends to use the drawing in color, the applicant must submit a color claim.  37 C.F.R. §2.52(b)(1); see TMEP §§807.07(a) et seq. 

 

 

Therefore, applicant must provide the required color claim.  The following is suggested, if accurate:  “The colors black and green are claimed as a feature of the mark.”  TMEP §807.07(a)(i).

The applicant did not comply but rather submitted the same description of the mark without a color claim. This requirement to submit an amended description of the mark and color claim as stated above is hereby made FINAL.

 

PROPER RESPONSE TO A FINAL

 

If applicant does not respond within six months of the date of issuance of this final Office action, the application will be abandoned.  15 U.S.C. §1062(b); 37 C.F.R. §2.65(a).  Applicant may respond to this final Office action by:

 

(1)  Submitting a response that fully satisfies all outstanding requirements, if feasible; and/or

 

(2)  Filing an appeal to the Trademark Trial and Appeal Board, with an appeal fee of $100 per class.
