The assigned examining attorney has reviewed the referenced application and determined the following.
The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.
THIS REQUIREMENT APPLIES ONLY TO THE GOODS SPECIFIED THEREIN
The identification of goods is unacceptable because the applicant must: 1.) indicate that its compact discs are “blank” or specify the subject matter featured on them; and 2.) specify the nature of its “recorders”, “crossovers”, “equalizers” and “remote controls”. The applicant may adopt the following identification, if accurate: “Home, mobile, marine, audio, video and computer electronic products and accessories therefor, namely ambience and surround sound processors, amplifiers, antennas for radio and television, audio sound enhancers, audio and video power cords, plugs, jacks, adaptors, connectors, wires, cables, band separators, electronic power supply units, power inverters, and selectors, blank compact discs, compact discs featuring [indicate subject matter, i.e. music], DVD players, adapters and recorders namely, [specify, i.e. video recorders], sound crossovers, electronic power supply units, graphic or sound equalizers, microphones, preamplifiers, remote controls for [indicate specific devices, i.e. radios, televisions, stereos], signal processors, subwoofers, cell phones, telephones, transformers, stereo tuners, televisions, tweeters, video stabilizing and picture enhancing controls, video switching units and junction boxes, volume and level controls, walkie-talkies, and wired and wireless headphones, wired and wireless head sets, loudspeakers, and audio and video receivers and transmitters, in International Class 9.” TMEP §1402.01.
Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted. 37 C.F.R. §2.71(a); TMEP §1402.06. Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.
