OFFICE SEARCH:  The examining attorney has searched the Office’s database of registered and pending marksand has found no conflicting marks thatwould bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.   

 

AMENDMENT:  The trademark examining attorney is amending the application as follows.  No prior approval or authorization from applicant or applicant’s attorney is required.  TMEP §707.02.

 

If the identification of goods and/or services has been amended, please note that any future amendments must be in accordance with 37 C.F.R. §2.71(a) and TMEP §1402.07(e).

 

CLASSIFICATION OF GOODS

Applicant classified the goods “nursing pads” in International Class 10; however, the correct classification is International Class 5. 

 

Accordingly, The application is amended to classify the “nursing pads” in International Class 5, which is already part of the application.  TMEP §1401.03(b); see 37 C.F.R. §2.85.

 

Proper classification of goods and services is a purely administrative matter within the sole discretion of the United States Patent and Trademark Office.  In re Tee-Pak, Inc., 164 USPQ 88, 89 (TTAB 1969).
