            This is a Response to the Office Action mailed May 22, 2009.

 

Pursuant to the requirement of the Examining Attorney, Applicant has disclaimed the exclusive right to use "ASSOCIATION" apart from the mark as shown.  In addition, Applicant has withdrawn its claim of acquired distinctiveness and replaced it with a claim of acquired distinctiveness in part as to the wording AMERICAN PSYCHOLOGICAL ASSOCIATION HUMANISTIC PSYCHOLOGY.  A Declaration claiming the wording "AMERICAN PSYCHOLOGICAL ASSOCIATION HUMANISTIC PSYCHOLOGY"  has become distinctive of the goods and/or services through applicant's substantially exclusive and continuous use in a type of commerce that may be lawfully regulated by the U.S. Congress for at least the five years immediately before the date of this statement is attached.

 

Because Applicant has satisfied all of the suggestions and requirements of the Examining Attorney, Applicant respectfully requests this application be approved for publication.  Should the Examining Attorney have any questions, she is invited to contact Applicant's counsel at (703) 412-6054.
