This Office action is in response to applicant’s communication filed on November 10, 2008.

 

The following are acceptable and have been entered into the record:  the amendment to the goods in International Class 7.

 

IDENTIFICATION OF GOODS AND/OR SERVICES

International Class 9

 

The wording “electric apparatus and their modules” in the identification of goods is indefinite and must be clarified because it does not indicate the specific type of apparatus and it is unclear as to the nature of the modules.  See TMEP §1402.01.  Applicant may substitute the following wording, if accurate:  “electric apparatus, namely, indicate type of apparatus for surface treatment of metals, polymers and semiconductors in the field of galvano plating.”

 

Identifications of goods and/or services can be amended only to clarify or limit the goods and/or services; adding to or broadening the scope of the goods and/or services is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.  Therefore, applicant may not amend the identification to include goods and/or services that are not within the scope of the goods and/or services set forth in the present identification.
