This letter responds to applicant’s communication dated 10/25/2007.  Applicant’s disclaimer of the words HOME CARE is acceptable as submitted.  Applicant’s amended recitation of services is unacceptable as submitted.  The requirements for an acceptable recitation of services and for additional money are now made FINAL for the reasons set forth below.  TMEP §1402.01.

 

FINAL REFUSAL - RECITATION OF SERVICES IS UNACCEPTABLE – CLARIFICATION IS NEEDED

 

The wording “lifestyle counseling” in the recitation of services is indefinite and must be clarified because the services were too broadly defined and because they include services that belong in more than one class.  The applicant needs to specifically indicate what the lifestyle counseling pertains to.  It should be amended to read as e.g. “lifestyle counseling in the field of preventive health, namely diet and nutrition”, in International Class 44” or as “personal lifestyle consulting services, in International Class 45.”  TMEP §1402.01, TMEP §§810, 904.09, 1403.01 and 1403.02(c).

 

INCLUDE ONLY SERVICES THAT ARE WITHIN THE SCOPE OF THE ORIGINAL RECITATION

 

Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. Section 2.71(b); TMEP section 804.09.  Therefore, the applicant may not amend to include any goods or services that are not within the scope of the goods and services recited in the present identification.

 

FINAL REFUSAL USE BASED APPLICATION – REQUIREMENTS FOR A COMBINED APPLICATION

 

If applicant prosecutes this application as a combined, or multiple-class application, then applicant must comply with each of the requirements below for those goods and/or services based on actual use in commerce under Trademark Act Section 1(a):

 

(1)   Applicant must list the goods/services by international class with the classes listed in ascending numerical order;

 

(2)   Applicant must submit a filing fee for each international class of goods and/or services not covered by the fee already paid (current fee information should be confirmed at http://www.uspto.gov); and

 

(3)   For each additional class of goods and/or services, applicant must submit:

 

(a)    dates of first use of the mark anywhere and dates of first use of the mark in commerce, or a statement that the dates of use in the initial application apply to that class; the dates of use, both anywhere and in commerce, must be at least as early as the filing date of the application;

 

(b)   one specimen showing use of the mark for each class of goods and/or services; the specimen must have been in use in commerce at least as early as the filing date of the application;

 

(c)    a statement that “the specimen was in use in commerce on or in connection with the goods and/or services listed in the application at least as early as the filing date of the application;” and

 

(d)   verification of the statements in 3(a) and 3(c) in an affidavit or a signed declaration under 37 C.F.R. §2.20.  (NOTE:  Verification is not required where (1) the dates of use for the added class are stated to be the same as the dates of use specified in the initial application, or (2) the original specimens are acceptable for the added class.)

Please note that the specimen(s) of record are acceptable for class 44 only.

 

The filing fee for adding classes to an application is as follows:

 

(1)     $325 per class, when the fees are submitted with a response filed online via the Trademark Electronic Application System (TEAS) at http://www.gov.uspto.report/teas/index.html; and

 

(2)     $375 per class, when the fees are submitted with a paper response.

Therefore, for the reasons listed above, the refusals to register under TMEP §1402.01, TMEP §§810, 904.09, 1403.01 and 1403.02(c) are now continued and made FINAL.

 

Applicant may respond to this final action by: 

 

(1)   submitting a response that fully satisfies all outstanding requirements, if feasible (37 C.F.R. §2.64(a)); and/or

 

(2)   filing an appeal to the Trademark Trial and Appeal Board, with an appeal fee of $100 per class (37 C.F.R. §§2.6(a)(18) and 2.64(a); TMEP §§715.01 and 1501 et seq.; TBMP Chapter 1200).

 

In certain circumstances, a petition to the Director may be filed to review a final action that is limited to procedural issues, pursuant to 37 C.F.R. §2.63(b)(2).  37 C.F.R. §2.64(a).  See 37 C.F.R. §2.146(b), TMEP §1704, and TBMP Chapter 1201.05 for an explanation of petitionable matters.  The petition fee is $100.  37 C.F.R. §2.6(a)(15).
