The request for extension of time to file a statement of use (extension request), filed on October 7, 2008, is premature and will not be reviewed.  The fee will be refunded in due course.

 

An extension request must be filed within six months of the mailing date of the notice of allowance, or before the expiration of a previously granted extension period. 15 U.S.C. §1051(d)(4); 37 C.F.R. §§2.65(c) and 2.88(h).  An applicant cannot file two extension requests within the same six-month extension period.  TMEP §1108.01.  Applicant’s first extension request was filed on May 28, 2008, second, request was filed on October 8, 2008, which is within the same six month extension period.  37 C.F.R. §2.89(a).

 

To avoid abandonment of the application, applicant must resubmit an extension request (or submit a statement of use) before expiration of the current extension period on ^.  15 U.S.C. §1051(d)(1); 37 C.F.R. §2.88(a); TMEP §1109.04.  Applicant is encouraged to submit the extension request (or statement of use) using the Trademark Electronic Application System (TEAS) at http://www.gov.uspto.report/teas/index.html.
