OFFICE SEARCH: The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d). TMEP section 704.02.
AMENDMENT: In accordance with the authorization granted by the applicant’s attorney, Brian T. Geisler, on August 14, 2007, the application has been AMENDED as indicated below. Please advise the undersigned immediately if there is an objection to the amendment.
If the identification of goods or services has been amended, please note that any future amendments must be in accordance with 37 C.F.R. 2.71(a); TMEP section 1402.07(e).
Claim of Ownership
The following claim of ownership is added to the record:
Applicant is the owner of U.S. Registration No. 2744393.

The application will be given priority as an amended application if a response to the requirements stated below is received within two months of the issue/mailing date.
The following issues were discussed in communication with the applicant’s attorney, Brian T. Geisler, on August 14, 2007.
Identification of Goods
The wording in the identification of goods needs clarification because it is too broad and could include goods classified in other international classes. TMEP §§1402.01 and 1402.03. The applicant must indicate the material from which the goods are made.
Please note that, while the identification of goods may be amended to clarify or limit the goods, adding to the goods or broadening the scope of the goods is not permitted. 37 C.F.R. §2.71(a); TMEP §1402.06. Therefore, applicant may not amend the identification to include goods that are not within the scope of the goods set forth in the present identification.
The applicant may adopt the following identification of goods, if accurate:
Metal caps for dispensing containers, in the nature of dispensing end closures, in Class 6;
Plastic dispensing end closures for containers, in Class 20.
Additional Class(es)
If applicant prosecutes this application as a combined, or multiple-class application, then applicant must comply with each of the following for those goods and/or services based on an intent to use the mark in commerce under Trademark Act Section 1(b):
(1) Applicant must list the goods by international class with the classes listed in ascending numerical order. TMEP § 1403.01; and
(2) Applicant must submit a filing fee for each international class of goods not covered by the fee already paid.
The filing fee for adding classes to an application is as follows:
(1) $325 per class, when the fees are submitted with a response filed online via the Trademark Electronic Application System (TEAS) at http://www.gov.uspto.report/teas/index.html; and
(2) $375 per class, when the fees are submitted with a paper response.
