This letter responds to the applicant’s communication filed March 9, 2010.  Receipt of the applicant’s response is acknowledged and has been entered.

 

 

 

Color location statement needed

 

 

Applicant has submitted a color drawing and color claim, but has not submitted the required color location statement.  Applications for color marks must include both a list of the colors that are claimed as a feature of the mark and a description of where the colors appear in the mark.  37 C.F.R. §2.52(b)(1); see TMEP §§807.07(a) et seq.  Generic color names must be used to describe the colors in the mark, e.g., magenta, yellow, turquoise.  TMEP §807.07(a)(i)-(a)(ii).

 

 

Therefore, applicant must provide a description of where the color(s) appear(s) in the mark using the following format:  “The mark consists of the color(s) blue, black, grey, and white, with a rectangular filter element in the colors black and white with a circle appearing in a corner thereof all in the colors blue, black, grey, and white. A square is shown within the circle and a wave-shaped designed is shown within the square all in the colors blue, black, grey, and white. A horizontal line extends through the wave-shaped design all in the colors blue, black, grey, and white.”  TMEP §807.07(a)(ii).
