Registrant requests the registration be amended to correct a minor clerical error in the original Applicant's name, pursuant to §7(h) of the Trademark Act, 15 U.S.C. §1057(h). Specifically, registrant requests that the name of the applicant as filed be changed from “Pilot Automotive, Inc.”, with a comma after “automotive,” to “Pilot Automotive Inc.” with no comma after “automotive.” Registrant notes that a mistake in the manner in which the name of the applicant is set out in the application may be corrected by amendment. TMEP §1201.02(c). A minor clerical error such as the mistaken addition or omission of "The" or "Inc." in the applicant's name may be corrected by amendment, as long as this does not result in a change of entity. Id. Additionally, "[i]f a mistake in a registration occurs in good faith through the fault of the owner of the registration,” such as in the instant case, “the Director may correct the error...provided the correction does not result in a change that would require republication of the mark." TMEP §1609.10(b). In this case, the original Applicant was mistakenly identified as Pilot Automotive, Inc., with a comma after “automotive.” However, the Applicant’s correct legal name was Pilot Automotive Inc., without the comma. This was a minor clerical error, made in good faith, and does not result in a change of entity. Accordingly, pursuant to 37 CFR § 2.175, Registrant requests correction of the applicant’s/registrant’s name to be corrected to remove the “comma” that was included in error when the application was filed.
