This letter is in response to the communication received from applicant’s attorney on March 24, 2008. Applicant was advised that it had three (3) classes of goods and services and that fees were only paid for two (2) classes. Applicant’s attorney responded and stated that it was paying for the third fee by credit card. No credit card authorization was received.
FAILURE TO FILE FEE, CLASS 9 WILL BE DELETED FROM THE APPLICATION
If applicant should fail to respond to this Office action within the six month time limit, then Class 9 will be deleted from the application and the application will proceed forward for Classes 11 AND 40 only. 37 C.F.R. §2.65(a).
Applicant should include the following information on all correspondence with the Office: (1) the name and law office number of the trademark examining attorney; (2) the serial number of this application; (3) the mailing date of this Office action; and, (4) applicant's telephone number. 37 C.F.R. §2.194(b)(1); TMEP §302.03(a).
