THIS IS A FINAL ACTION.
This letter is in response to the communication received on January 28, 2008. Applicant has responded and (1) amended to description of goods and services; (2) provided a claim of ownership of the prior registrations; and (3) submitted an additional filing fee. Numbers 1 and 2 are acceptable. Applicant still has an insufficient amount of fees for this three class application.
The application identifies goods and/or services that are classified in at least THREE (3) classes; however, the fees submitted are sufficient for only TWO (2) classes. In a multiple-class application, a fee for each class is required. 37 C.F.R. §2.86(a)(2); TMEP §§810-810.01 and 1403.01.
Therefore, applicant must either: (1) restrict the application to the number of class(es) covered by the fee(s) already paid, or (2) submit the fees for the additional class(es).
The requirement to either file another fee or limit the classes in the application is continued and made FINAL.
