The application will proceed to publication under Section 2(f) based on the evidence of acquired distinctiveness submitted by the applicant with his submission of September 17, 2007.

Identification and Classification of Services

The identification and classification of services is amended to read as follows: “Entertainment services, namely, live performances by a musical band.” TMEP §1402.01(e).

The mark is approved for publication for opposition.
