The Sections 8 & 15 Combined Affidavit was received on July 9, 2013.  The Section 8 portion of the Combined Affidavit is accepted.  However, the Office cannot acknowledge the Section 15 portion for the reason(s) set forth below.

 

ISSUES PERTAINING TO SECTION 15 PORTION ONLY

 

Supplemental Register registrations are not eligible for the benefits of Trademark Act Section 15.  The provisions of Trademark Act Section 15 apply only to (1) registrations issued on the Principal Register under the Act of 1946; and (2) registrations issued under the Acts of 1905 and 1881 that have been “published” under Trademark Act Section 12(c), to claim the benefits of the Act of 1946.  15 U.S.C. §1065; 37 C.F.R. §§2.167 and 3.73(b); TMEP §1605.01. 

 

Accordingly, the Section 15 Affidavit cannot be acknowledged for the subject Supplemental Register registration.

 

Any fees submitted with the Section 15 Affidavit will be refunded in due course.
