This is further to the telephone consultation between the Examining Attorney and Oblon Spivak attorney Christopher Donahue on December 13, 2007, during which the Examining Attorney acknowledged Applicant had submitted the Section 44(e) home country registration and English translation at the time of filing the application. Applicant has again attached the home country registration only because it is required in order to use the TEAS Response to Letter of Suspension form, and no other TEAS form can be used. As of March 27, 2008, the USPTO TARR database still shows Serial No. 76/667510 as suspended. The Examining Attorney indicated that a drawing of the mark with better resolution may be necessary. Attached is a substitute drawing in JPEG format. Prompt action on this application is respectfully requested. |
