THIS IS A FINAL ACTION

 

This Office action is in response to applicant’s communication filed on March 10, 2008.  Applicant submitted a legible specimen.  While the specimen meets all necessary requirements, it cannot be accepted and entered into the record until it is properly verified.  In its response, applicant states that the specimen is a true copy of the originally submitted specimen.  However, upon review of the specimens, this does not appear to be the case.  Therefore, the specimen submitted on March 10, 2008 is a substitute specimen requiring a supporting statement verified with an affidavit or signed declaration under 37 C.F.R. §2.20.  Accordingly, the specimen requirement is maintained and made FINAL.  

 

Applicant should add the following declaration paragraph to the end of its response, and include a dated signature by a person authorized under 37 C.F.R. §2.33(a).  37 C.F.R. §2.20.

 

DECLARATION FOR A SUBSTITUTE SPECIMEN

 

The following is a sample declaration under 37 C.F.R. §2.20 with a supporting statement for a substitute specimen:

 

The undersigned being warned that willful false statements and the like are punishable by fine or imprisonment, or both, under 18 U.S.C. §1001, and that such willful false statements and the like may jeopardize the validity of the application or document or any registration resulting there from, declares that the substitute specimen was in use in commerce prior to the expiration of the time allowed applicant for filing a statement of use; all statements made of his/her own knowledge are true; and all statements made on information and belief are believed to be true.

PROPER RESPONSE TO FINAL OFFICE ACTION

 

If applicant does not respond within six months of the mailing date of this final Office action, the application will be abandoned.  15 U.S.C. §1062(b); 37 C.F.R. §2.65(a).  Applicant may respond to this final Office action by: 

 

(1)     Submitting a response that fully satisfies all outstanding requirements, if feasible; and/or

 

(2)     Filing an appeal to the Trademark Trial and Appeal Board, with an appeal fee of $100 per class.
